Diversinet respects your right to privacy and, being in the security business, we understand the inherent privacy risks involved in using the Internet.  For this reason, we believe that you have the right to know how Diversinet collects and uses your information.  Diversinet believes in the principles under the Personal Information Protection and Electronic Documents Act (PIPEDA).

Online Privacy

Diversinet Corp. and its subsidiaries (“Diversinet”) would like to make use of individual identifying information that you provide to us for purposes of informing you of upcoming events and news.  Individual identifying information is information that enables us to identify you, such as your email address, name, title and address.  Diversinet uses the individual identifying information in order to develop better products and services, share it with our business partners, and to be able to selectively send you communications that may be of interest to you, either electronically or otherwise.

Collection of Personal Information

In your dealings with Diversinet you may provide Diversinet with personal information, such as your telephone number, email address, name, home or work address.  We may also collect demographic information, such as your ZIP or postal code, age, gender, preferences, interests and favorites.  We may also supplement the information we collect with information obtained from other companies.  For example, we may use services from other companies that enable us to derive a general geographic area based on your IP address in order to customize certain services to your geographic area.

Use and Disclosure of Personal Information

Diversinet collects and uses your personal information to operate and improve its sites and services.  These uses may include providing you with more effective customer service; making the sites or services easier to use by eliminating the need for you to repeatedly enter the same information; performing research and analysis aimed at improving our products, services and technologies; and displaying content and advertising that are customized to your interests and preferences.  Except as part of the sale of all or substantially all of the assets of Diversinet, we will not sell, trade or rent your personal information to any third party unless we have your consent.  Some Diversinet services may be co-branded and offered in conjunction with another company.  If you register for or use such services, both Diversinet and the other company may receive information collected in conjunction with the co-branded services  We also reserve the right to use, disclose, sell, trade, or rent data aggregated provided that the data is not linked to any specific individual.

Except where we are required by law to disclose personal information, we will require any person to whom we provide your personal information to agree to comply with our then current Privacy Policy.  We will take reasonable commercial efforts to ensure that they comply with our Privacy Policy, however we will have no liability to you if any person fails to do so.

To be able to serve you, your personal information may be collected, stored and/or processed or otherwise used by or on our behalf both inside and outside of Canada by third party service providers, to perform functions on our behalf.  As a result, that country’s courts, governments or law enforcement agencies could obtain disclosure of such information under that country's laws.

Use of Cookies

Like many other commercial web site, the Diversinet web site may use a standard technology called a ‘cookie’.  A cookie is a unique text file that a Web site can send to your software.  Cookies are small bites of information that are stored by your browser on your computer’s hard drive.  Our cookies allow us to recognize each returning customer and their relevant information so that you do not need to input the same information more than once.  A cookie cannot retrieve any other data from your hard drive, pass on computer viruses, or capture your e-mail address.  We do not place any personally identifiable information in your cookies.  In addition, cookies are not used to access information entered on the secure server.  This information can only be accessed when you enter your name and password or in conjunction with your one-time password.

Security of Your Personal Information

Diversinet is committed to protecting the security of your information, including personal information.  We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure.  More specifically, our server uses SSL (Secure Sockets Layer) security protection by encrypting all of your personal information including credit card number, name and address to prevent individuals from reading this information as it travels over the Internet.  If a password is used to help protect your accounts and personal information, it is your responsibility to keep your password confidential.  Do not share this information with anyone.  If you are sharing a computer with anyone you should always log out before leaving a site or service to protect access to your information from subsequent users.

Information about all Diversinet Visitors

In general, our service may automatically gather certain usage information like the numbers and frequency of visitors to our site and its areas.  We only use such data in the aggregate.  This collective data helps us determine how much our customers use parts of the site, so we can improve our site to assure that it is as appealing as we can make it for as many of you as possible

PIPEDA

In order to protect the privacy of customers, employees, and clients of Diversinet we have adopted ten privacy principles contained within PIPEDIA.

  1. Accountability - A Privacy Officer must be appointed (and carry out all the necessary tasks, including developing and implementing personal information policies).  The Privacy Officer for Diversinet is David Annan.

  2. Identifying Purposes - Before collecting or disclosing any information the purposes must be clearly and distinctly stated.

  3. Consent - Before using a person's information their consent must be given.  The person must be aware of the reasons for their data being used, including when a new use is identified.

  4. Limiting Collection - If information is not necessary then it need not be collected. As well, the reasons for information collection must always be true and clear- no deceptions.

  5. Limiting use, disclosure, and retention- Information obtained from an individual will not be used for any purposes other than those which were clearly stated from the start, unless the individual consents.  Any information that is no longer of use to the organization will be destroyed.

  6. Accuracy - The information that is kept at Diversinet must be valid, and up-to-date.  When making decisions about individuals or disclosing information it will first be verified that the information is, in fact, accurate.

  7. Safeguards - All personal information obtained by Diversinet will be stored securely, and protected against unauthorized access, disclosure, copying, use or modification.

  8. Openness – Diversinet’s Privacy Policies must be easily understood, and available for anyone to read.

  9. Individual access - Any individual has the right to know what personal information Diversinet has about them, and for what purposes it is being used. This individual can amend any personal information if they see fit, and should be provided with a copy if they so wish.

  10. Provide recourse - Simple complaint procedures must be in place, and complainants must be informed (if they ask) about methods to solve their issues.  All complaints are to be investigated, and if the complaint is valid then new policies must be created to ensure that all privacy is upheld.
